Terms of Service
PetitionAdvisor Version 1.0 — Effective June 25, 2026
Read this first. PetitionAdvisor is a self-help document service. It is not a law firm, does not provide legal advice, and does not represent you. It does not predict whether your petition will be approved or denied. You prepare and file your own petition.
These Terms of Service ("Terms") are a binding agreement between you ("you," "your," or "user") and PetitionAdvisor ("PetitionAdvisor," "we," "us," or "our"), the operator of the website petitionadvisor.com (the "Site") and the document-assessment service offered through it (the "Service"). By accessing the Site, checking the box to accept these Terms, or purchasing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service is — and what it is not
PetitionAdvisor lets you upload your own EB-2 National Interest Waiver ("NIW") petition materials and receive a written, self-help assessment that compares your own document against the publicly available USCIS adjudication standard set out in Matter of Dhanasar and related EB-2 eligibility criteria. The assessment identifies areas of your document that may need strengthening and provides a plain-language action checklist.
The Service is NOT, and you agree it is not:
- Legal advice. We do not interpret the law for your specific situation, advise you on legal strategy, or tell you what you are legally required to do.
- A law firm or an attorney. No attorney-client relationship is created by your use of the Service. No lawyer reviews, supervises, or is responsible for your assessment.
- Representation. We never act on your behalf, communicate with USCIS for you, or file anything for you. You prepare and file your own petition.
- A prediction or guarantee of any outcome. We do not state, estimate, or imply the likelihood that USCIS will approve or deny your petition. No result is promised.
- A substitute for a licensed immigration attorney. Many situations require one. See Section 4.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for individuals preparing their own petitions. By using the Service you represent that you meet these requirements.
3. Your responsibilities — accuracy and honesty
You are solely responsible for the content you submit. You agree that:
- Everything you upload is true, accurate, and your own work, and you have the right to submit it.
- You will not use the Service to inflate, fabricate, conceal, or misrepresent any fact, credential, or evidence. PetitionAdvisor exists to help you present, clearly and completely, what is genuinely true about you. We do not assist with deception of any kind.
- You will not upload anyone else's confidential information without authorization, or any unlawful, infringing, or malicious content.
- You will not misuse the Service, attempt to disrupt or reverse-engineer it, or use it to build a competing product from our outputs or methodology.
4. Free safety check; situations we route to an attorney
Before any purchase, the Service runs a free pre-screening ("safety check"). Some situations are time-sensitive and beyond the scope of self-help. If your safety check indicates any of the following, the Service will direct you to consult a licensed immigration attorney and will not charge you:
- You have received a Request for Evidence (RFE), a Notice of Intent to Deny (NOID), or a denial, or you are in an appeal or motion;
- You are in immigration court or removal (deportation) proceedings, or are subject to a removal order;
- You have a question about lawful presence, admissibility, or status that affects your eligibility.
This routing is for your protection. The Service does not handle contested, litigation, appeal, or removal matters.
5. Intellectual property
Your content. You retain all rights to the documents and information you submit. You grant PetitionAdvisor a limited, non-exclusive license to access, process, and use your submitted content only for the purpose of producing and delivering your assessment and operating the Service, and only for as long as needed to do so (see our Privacy Policy for retention details).
Our content. The Site, the Service, the assessment format, the underlying methodology, knowledge base, prompts, software, text, and design are owned by PetitionAdvisor and protected by intellectual-property laws. Your assessment is provided for your personal, non-commercial use in connection with your own petition. You may not copy, resell, redistribute, or use our materials or methodology to build or train a competing service.
6. Payment
The Service is offered for a one-time, flat fee as stated on the Site (currently $50 USD per assessment), unless otherwise displayed at checkout. Payments are processed by Stripe; we do not receive or store your full payment-card details. You authorize the charge shown at checkout. Prices may change prospectively, but the price shown to you at the time of purchase governs that purchase.
7. Refunds
Refunds are governed by our Refund Policy, which is incorporated into these Terms by reference. Please read it before purchasing.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains what we collect, how we use it, how long we keep it, the third-party processors we rely on, and your rights. By using the Service you agree to the Privacy Policy.
9. Third-party services
The Service relies on third-party providers, including Stripe (payments), Anthropic (AI processing of your document), Vercel (hosting and file storage), and Resend (email delivery). Your data is processed by these providers as described in our Privacy Policy. We are not responsible for the acts, omissions, or independent policies of third parties, but we select providers whose terms are consistent with the commitments in our Privacy Policy.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. PETITIONADVISOR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ANY ASSESSMENT WILL BE COMPLETE OR SUITABLE FOR YOUR PARTICULAR PURPOSE, OR THAT USING THE SERVICE WILL RESULT IN ANY PARTICULAR OUTCOME WITH USCIS. AN ASSESSMENT IS INFORMATIONAL SELF-HELP FEEDBACK BASED ON A PUBLISHED STANDARD AND IS NOT A SUBSTITUTE FOR THE JUDGMENT OF A LICENSED ATTORNEY.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PETITIONADVISOR AND ITS OPERATOR(S) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, OPPORTUNITY, OR IMMIGRATION BENEFIT, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE ASSESSMENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless PetitionAdvisor and its operator(s) from any claim or demand arising out of your breach of these Terms, your misuse of the Service, or content you submit, including any claim that your submitted content was untrue, unauthorized, or infringing.
13. Changes to the Service and these Terms
We may modify or discontinue the Service, and may update these Terms, at any time. Material changes will be reflected by updating the "Effective" date above and posting the revised Terms on the Site. Your continued use after changes take effect constitutes acceptance.
14. Governing law and dispute resolution
These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws rules. Before filing any formal action, you agree to first contact us at support@petitionadvisor.com and attempt in good faith to resolve the dispute informally for at least 30 days. Any dispute not resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in Missouri, unless applicable consumer-protection law gives you the right to proceed elsewhere.
15. General
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and PetitionAdvisor regarding the Service. You may not assign these Terms; we may assign them in connection with a transfer of the Service.
