Privacy Policy

PetitionAdvisor Version 1.0 — Effective June 25, 2026

PetitionAdvisor ("we," "us," or "our") operates the website petitionadvisor.com (the "Site") and the self-help EB-2 NIW document-assessment service offered through it (the "Service"). This Privacy Policy explains what information we collect, how we use it, how long we keep it, who processes it, and the rights you have.

We treat privacy as a core feature of this Service. We do not sell your personal information, and we do not use your documents to train AI models.

1. Information we collect

Information you provide directly:

  • Free quick-check tool: the field/profession and short endeavor description you enter.
  • Full assessment: the petition materials you upload (which may include your cover letter, endeavor statement, CV, recommendation/support letters, exhibits, and credential evaluations). These documents may contain sensitive personal information — for example your name, contact details, immigration and employment history, education, and professional background. You decide what to upload.
  • Safety-check answers: your responses to the pre-screening questions (e.g., whether you have an RFE, are in removal proceedings, or have a lawful-presence question).
  • Email address: so we can deliver your assessment and respond to support requests.

Information collected automatically:

  • Payment: when you purchase, Stripe processes your payment. Stripe collects and handles your payment-card details directly; we do not receive or store your full card number. We receive a confirmation of payment and limited transaction metadata.
  • Site operation: we and our hosting provider may process limited technical data (such as IP address and basic request logs) necessary to run and secure the Site.
  • Analytics/cookies: the Site uses cookies that are strictly necessary to operate it and to process payment through Stripe. If we enable optional analytics (for example, to understand site traffic), we will identify it here and obtain consent where required.

2. How we use your information

We use your information only to:

  • produce and deliver your document assessment;
  • run the free safety check and, where appropriate, advise you to consult a licensed attorney;
  • process your payment and provide receipts and support;
  • operate, secure, and improve the Site (without using your uploaded documents to train AI — see Section 4);
  • comply with legal obligations and enforce our Terms.

Legal bases (for users in the EEA/UK). We process your information to perform our contract with you (delivering the assessment you requested), based on your consent (which you may withdraw), and to meet our legitimate interests in operating and securing the Service and our legal obligations.

3. We do not sell your data; limited sharing

We do not sell or rent your personal information, and we do not share it for advertising. We share information only with the service providers ("sub-processors") listed below, strictly to deliver the Service, or where required by law (for example, in response to a valid legal request) or to protect rights and safety.

4. AI processing and our no-training commitment

To produce your assessment, the content of your documents is processed by Anthropic via its Claude API.

  • We access Anthropic's API under Anthropic's Commercial Terms. Under those terms, Anthropic does not use API inputs or outputs to train its models.
  • Anthropic may retain API data for a limited period (up to approximately 30 days) for abuse-monitoring and to meet legal obligations, after which it is deleted; certain API configurations support zero data retention. Anthropic's handling is governed by its own commercial terms and privacy documentation.
  • We do not use your documents, your assessment, or your inputs to train, fine-tune, or develop any AI model.

5. Sub-processors

We rely on the following providers to deliver the Service. Each processes your data only as needed for its function and under its own privacy and security terms:

Vercel Website hosting and temporary storage of uploaded files
Stripe Payment processing (handles your card details directly)
Resend Delivery of your assessment and related emails

We may update this list as our providers change and will keep this section current.

6. How long we keep your information

  • Uploaded petition documents: deleted from our storage promptly after your assessment is delivered — within 24 hours of delivery.
  • Free-tool inputs: retained only as needed to return your quick-look result and are not stored long-term.
  • Assessment email and minimal transaction records: retained only as long as necessary for support, accounting, and legal compliance, then deleted.
  • Sub-processor retention: as described in Section 4 and each provider's terms (for example, Anthropic's limited abuse-monitoring window).

We design for the smallest retention footprint consistent with delivering the Service and meeting our legal obligations.

7. Security

We use reasonable technical and organizational measures to protect your information, including encryption in transit, access controls, and processing through reputable providers. No method of transmission or storage is perfectly secure, and we cannot guarantee absolute security; you submit information at your own risk.

8. Your rights

Depending on where you live, you may have the right to:

  • access the personal information we hold about you;
  • request correction of inaccurate information;
  • request deletion of your information;
  • request a copy/portability of information you provided;
  • withdraw consent or object to certain processing;
  • be free from discrimination for exercising these rights (California/CCPA).

To exercise any of these rights, email support@petitionadvisor.com. We will respond as required by applicable law. Because we retain uploaded documents only briefly, much of your submitted content is deleted automatically shortly after delivery.

9. International users and data transfers

We operate in the United States, and your information is processed in the United States and by the sub-processors listed above. If you access the Service from outside the U.S. (including the EEA or U.K.), you understand your information will be transferred to and processed in the U.S., which may have different data-protection rules than your home country. Where required, we rely on appropriate safeguards for such transfers.

10. Children

The Service is intended for adults (18+) preparing their own petitions and is not directed to children. We do not knowingly collect personal information from anyone under 18.

11. Changes to this Policy

We may update this Privacy Policy from time to time. We will post the revised version with a new "Effective" date. Material changes will be reflected on the Site.
